DIGITALIZATION IN CIVIL PROCESSES UNDER THE ASPECTS OF DEMOCRACY, RULE OF LAW AND HUMAN RIGHTS
Abstract
The German Civil Procedure Code dates back to 1877. It was characterized by the freedom and dispositiveness of the parties, orality, immediacy and publicity, as well as by the free evaluation of the evidence, which is why it was a very liberal and modern legal body . Its basic structures still apply today, with certain restrictions. Understandably, the 1877 legislator knew nothing about digitization. But in the 21st century it has not been idle and has embraced the idea of electronic justice and electronic legal traffic applying them in various ways.
