THE JUDICIAL ADAPTATION OF THE PROCEDURE FROM A PANPROCESSUAL PERSPECTIVE: THE POSSIBLE ROUTE BETWEEN COURT AND CASE MANAGEMENT

the article deals with the adjustment on the procedure and procedural institutes to the context of the civil justice system, which for a proper functioning must rethink the model of individualized treatment of cases. The deductive method is used, from the doctrine of procedural law and the theory of Law, using comparative law. Recalling that the institutional mission of the Judiciary is to pacify the Law and operate according to principles applicable to public service, the work concludes that it is necessary to recognize the judicial power to adapt the procedure in a pan-procedural perspective, with the discovery of new meanings of procedural institutes, as a means of enabling the efficiency of judicial management.
