The name as a pillar of identity: a right linked to human dignity

Abstract

This article examines the right to a name as a cornerstone of identity and human dignity, taking as its point of departure the case of Isidro V., an adolescent who judicially obtained the removal of his first name and paternal surname. The central question addressed is: how are the right to a name, personal identity, and human dignity interconnected within the Argentine context, particularly with regard to children and adolescents? The aim is to analyze the significance of the name in the construction of identity and in the safeguarding of progressive autonomy, showing how case law reflects a human rights–oriented approach that prioritizes the best interests of the child. The methodology is qualitative, based on a legal-dogmatic and jurisprudential approach, combining a case study with a review of national and international normative and doctrinal sources.
