Abstract

The article examines the epistemological assumptions of La condición multiparadigmática del Derecho, with particular attention to the notion of scientificity that structures the model. It reconstructs Nicolás Salvi’s use of Kuhn’s framework to address the theoretical plurality of the legal field and outlines its limitations. Two main objections are raised: law’s proximity to technological production rather than natural science, and the way paradigm coexistence reinforces an understanding of law as a rhetorically and institutionally situated practice. Based on these points, and drawing on Mario Bunge’s perspective, the article suggests conceiving law as a socially organized technology, normatively structured and governed by persuasive validation mechanisms. Rather than stabilizing an epistemic model, the multiparadigmatic approach makes visible the conflictual and contingent nature of legal knowledge.
