The present investigation seeks to elucidate the effects that the application of artificial intelligence will have on the criminal procedure, for this objective, we carry out an analysis regarding the functioning of AI, and it’s full capabilities. Finally, we proceed with the analysis of case studies regarding the application of AI in the criminal procedure, through this, we determine the level of vulneration that represents the irresponsible and overconfident usage of artificial intelligence for impartiality, transparency and presumption of innocence, in the frame of the criminal procedure.
